DOLPHIN ENGINES TERMS AND CONDITIONS
“We”, “us” and “our” refer to
Dolphin Engines. “You” and “Your” refer to
the customer who is placing the order with us. By placing an order you confirm that you accept the following terms & conditions:
It is our responsibility to supply you with goods that meet your consumer rights. If you have any concerns that we have not met our
legal obligations please contact us.
Management reserve the right to alter product prices, specification and availability at any time and without notice.
Every effort has been made to display correct product description and specification, however this could differ from goods supplied.
Every effort is made to keep information regarding stock availability up to date on our website, however we cannot guarantee that items
listed are in stock. If an order is placed for an unavailable item we will notify you, and provide a new estimated delivery time. If we
are unable to provide an item we will contact you to discuss a possible replacement/ substitute. In the event that no replacement/substitute
is available or you do not wish to take it a refund will be issued.
It is your responsibility to ensure that any goods ordered are suitable for your application.
Any item that fails within 12 months of purchase will be replaced providing the damage/failure is a genuine product
fault and has not been caused by accident or misuse. You must read any manuals and follow any safety, fitting or care instructions provided.
Orders are normally dispatched within 5 working days after full payment has been received.
Details of delivery charges will appear when placing an order, before payment is requested.
Orders are often sent with one of the following services depending on weight and/or destination: 1St Class Royal Mail,
2nd Class Royal Mail, Special Delivery Royal Mail, Airmail Small Packets or Parcel Force Global Value.
Our standard delivery options are: 2nd Class Royal Mail, Parcel Force Express 48 or Parcel Force Global Value.
Delivery times are approximate.
We are not responsible for any delays in delivery and any inconvenience this may cause.
You should let us know as soon as possible if you do not receive your order within one week of any estimated delivery date we give you.
Any items marked with “long lead time” are excluded from the above terms and conditions in the “Delivery” section.
After receiving an order it is your responsibility to check that it is complete. You should notify us of any problems within 7
days of receiving the goods.
Any loss or damage to the goods that occurs after they have been delivered to you will be your responsibility.
If we are unable to supply goods within 30 days of your order, you may cancel and will be entitled to a full refund.
Accepted methods of payment are shown on the relevant section of our website.
All orders are invoiced in UK Pounds Sterling.
Payment for overseas sales is accepted by PayPal only.
All product prices are shown excluding VAT. Standard rate VAT is added at the checkout.
A VAT invoice will be dispatched with the goods.
If you are a VAT registered business within the EU we will refund VAT within 30 days of payment, providing the total order value is over £20.00 and
a valid VAT number is provided at the time of order. (Subject to validity checks).
Orders from countries outside the EU will be zero-rated as long as the goods are delivered to an address outside of the EU.
Any customs or import duties charged for overseas orders are your responsibility.
Cancellation & Returns
You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and
indicated by you acquires, physical possession of the last good.
To exercise the right to cancel, you must inform Dolphin Engines of your decision to cancel this contract by a clear statement
(e.g. a letter sent by post or email). You may use the attached model cancellation form, but it is not obligatory. Our postal address and
our email address can be found on the “contact us” page of our website (www.dolphinengines.co.uk) or at the bottom of these terms.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel
before the cancellation period has expired.
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the
supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is a result of any unnecessary handling by you.
We will make the reimbursement without undue delay, and not later than;
a) 14 days after the day we receive back from you any goods supplied, or
b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
In any event, you will not incur fees as a result of the reimbursement. We may withhold reimbursement until we have received the
goods at our premises, or you have supplied evidence of having sent back the goods in a re-saleable condition, whichever is earliest.
In the event that you wish to cancel the contract, you shall return the goods to Dolphin Engines, The Forge Workshops,
Tresillian, Truro, Cornwall, UK, TR2 4AX, marked for the attention of “The manager“, without undue delay and in
any event not later than 14 days from the day on which you communicate your cancellation of this contract to us.
The deadline is met if you send back the goods before the period of 14 days has expired.
You will bear the direct cost of returning the goods to us. The cost is estimated at a maximum of approximately 100.00 GBPs
for larger and heavier items that may not normally be returned by post.
You are liable for any diminished value of the goods resulting from your handling, other than what is necessary to establish
the nature, characteristics and functioning of the goods.
Your right to cancel does not apply to goods that have been made to your specifications or personalised in any way.
If you wish to cancel a contract for the provision of a service or services and you requested to begin or to complete the
performance of the service(s) during the cancellation period you shall pay us an amount which is in proportion to what has
been performed up to the time that you communicated to us your cancellation of the contract. If we have performed all of the
service(s) covered by the contract, you shall pay the amount in full.
Faulty or damaged goods
In the unlikely event you receive any goods from us that are faulty or damaged you must notify us as soon as is practically possible,
and within 7 days of receipt of the goods.
In the event of any goods being faulty, we will reimburse the cost of the goods, cost of delivery and cost of return postage to our address
(below) or alternatively we may be able to arrange collection (e.g. especially for a large or heavy item).
We will arrange for a replacement item to be sent to you as soon as is practical. If a replacement item is not available a refund will be processed.
If damaged or faulty goods are not returned to us within 30 days you may not be eligible for a full refund.
Goods that were known to be faulty when purchased are not returnable and no costs or associated costs will be reimbursed.
Goods that have been damaged or modified in any way are not returnable.
